There are di\ufb00erent lawful bases depending on the stage at which I am processing your data. Your signed <br \/>contractual agreement will con\ufb01rm understanding of the Privacy Policy. <br \/>\u2022 If you are currently having therapy or if you are in contact with me to consider <br \/>therapy, I will hold and process your personal data as it is necessary for the <br \/>performance of the service o\ufb00ered (in this case, counselling) and is necessary for a <br \/>contract with a health professional (in this case, a contract between you and me). <br \/>\u2022 GDPR also requires me to ensure that I look after any sensitive personal information <br \/>that you may disclose to me appropriately. This type of information is called \u2018special <br \/>category personal information\u2019. This data is collected when needed to ensure that <br \/>you receive a safe and professional service. The lawful basis for my processing any <br \/>special categories of personal information is by consent to provide an appropriate <br \/>treatment plan. This will include such details as name, address,<br \/>date of birth, presenting issues, next of kin, emergency contact details and will be clear on<br \/>the assessment form. I will always speak to you about this \ufb01rst unless you cannot<br \/>be contacted, e.g. a child in session and an immediate concern or a vulnerable person.<\/mark><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><mark class=\"has-inline-color has-dark-gray-color\" style=\"background-color: rgba(0, 0, 0, 0);\">I will keep a record of your personal details to help the counselling services run smoothly.<br \/>These details are kept securely and encrypted digitally on OneDrive or in paper form in a<br \/>locked cabinet and are not shared with any third party. Clinical supervision is part of a<br \/>necessary requirement to practce but cases are brought anonymously. The session notes<br \/>are coded. The building is alarm-controlled and serviced regularly, as evidenced by<br \/>cert\ufb01cation.<\/mark><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><mark class=\"has-inline-color has-dark-gray-color\" style=\"background-color: rgba(0, 0, 0, 0);\">I will keep written notes of each session; these are kept for 5 years and are stored in a locked<br \/>cabinet in a locked room. Online communication is two-factor protected. For security<br \/>reasons, I ensure my telephone is security updated, password protected and password<br \/>changed regularly. WhatsApp is encrypted. Video sessions are conducted using VSee, which<br \/>is encrypted \u2013 they are not digitally recorded.<\/mark><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><mark class=\"has-inline-color has-dark-gray-color\" style=\"background-color: rgba(0, 0, 0, 0);\">If there is relevant information contained in a text or encrypted WhatsApp message, I will<br \/>ensure that this information is not shared, and the work telephone is safely monitored at all<br \/>times. No other party will have access to this except the secretary of the Practice.<\/mark><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><mark class=\"has-inline-color has-dark-gray-color\" style=\"background-color: rgba(0, 0, 0, 0);\">Likewise, any email correspondence is held securely on one drive with two-factor security.<\/mark><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:heading {\"level\":4} --><\/p>\n<h4 class=\"wp-block-heading\"><mark class=\"has-inline-color has-dark-gray-color\" style=\"background-color: rgba(0, 0, 0, 0);\">After counselling has ended<\/mark><\/h4>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><mark class=\"has-inline-color has-dark-gray-color\" style=\"background-color: rgba(0, 0, 0, 0);\">Once counselling has ended, all your records will be kept for 5 years from the end of our<br \/>contact with each other, in keeping with professional insurance requirements and<br \/>professional guidelines. Paper records are then securely destroyed. Digital records are<br \/>deleted permanently. Where I have knowledge of a safeguarding issue or legal action, I<br \/>reserve the right to hold the record until that reason no longer exists.<\/mark><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><mark class=\"has-inline-color has-dark-gray-color\" style=\"background-color: rgba(0, 0, 0, 0);\">Third-party recipients of personal data \u2013 referrals \u2013 e.g., Agencies or Insurance Companies<\/mark><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph {\"style\":{\"elements\":{\"link\":{\"color\":{\"text\":\"var:preset|color|dark-gray\"}}}},\"textColor\":\"dark-gray\"} --><\/p>\n<p class=\"has-dark-gray-color has-text-color has-link-color\">I sometimes share personal data with third parties, for example, where I have contracted<br \/>with a referrer to carry out speci\ufb01c tasks. I reserve the right to<br \/>Reject any such request which would be declined because of the relevance of this work.<br \/>There is also a requirement to retain client records in order to ful\ufb01l professional insurance<br \/>and professional indemnity. The information is not erased in the interests of the client\u2019s<br \/>welfare. If consent is requested to be withdrawn, counselling will not continue as the service<br \/>cannot be provided e\ufb00ec8vely.
